1. Acceptance & binding nature

These Terms & Conditions ("Terms") are a binding agreement between you and Travill Holdings LLC, doing business as The Burgundy ("The Burgundy," "we," "our," or "us"). By (a) using the website at theburgundyinn.com (and, when live, theburgundyinn.com) (the "Site"), (b) submitting a form or inquiry, (c) booking a reservation, (d) staying at the hotel located at 41121 Big Bear Blvd, Big Bear Lake, CA 92315 (the "Property"), or (e) using any of the Property's amenities, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site, do not book, and do not enter the Property.

2. Eligibility

To book a reservation, you must be at least 21 years of age, have the legal capacity to enter into a binding contract under California law, and present a valid government-issued photo ID and a credit or debit card in your name at check-in. Reservations made in another person's name will be canceled at check-in if the named guest cannot be verified.

3. Reservations & booking process

Reservations are processed by our booking partner Cloudbeds (booking-engine ID xdZJ14). By booking, you also agree to Cloudbeds' Terms of Service and Privacy Policy. A reservation is not confirmed until you receive a written confirmation (email or SMS, per your consent selections) from Cloudbeds containing a reservation number.

We reserve the right to refuse, cancel, or reassign any reservation for lawful reasons, including but not limited to: incomplete or inaccurate information; suspected fraud or chargeback risk; prior eviction from the Property; threatened or actual violation of these Terms; force majeure (see § 18); overbooking caused by channel-manager error (in which case we will offer comparable alternative accommodations or a full refund at your election); or violation of applicable law. If we cancel a confirmed reservation for any reason other than your violation of these Terms or force majeure, we will, at your election, refund all amounts paid or re-book you at a comparable property at no additional cost subject to availability.

4. Rates, taxes, fees & payment

Quoted room rates are exclusive of all applicable taxes, occupancy assessments, resort fees (if any), pet fees, parking fees (if any), and incidental charges, unless explicitly stated otherwise. Mandatory charges that apply to your stay will be itemized in your confirmation. Current taxes include the City of Big Bear Lake transient occupancy tax (TOT) and the Big Bear Lake tourism business improvement district (BID) assessment, in addition to any California sales tax on taxable goods.

We accept Visa, MasterCard, American Express, and Discover. A valid credit card is required to guarantee your reservation. Your card is authorized at the time of booking for room and tax; additional incidental authorizations may be placed at check-in (see § 9). Final charges post at check-out. All transactions are in U.S. Dollars (USD); foreign-transaction fees imposed by your bank are outside our control.

5. Cancellation, modification & no-show policy

The specific cancellation policy for your reservation is set forth in your booking confirmation, and that policy controls. In general:

  • Flexible rate. Cancel by 4:00 PM local time, two (2) days prior to your arrival date, with no penalty. Cancellations within the 48-hour window or no-show will be charged the first night's room and tax.
  • Non-refundable / advance-purchase rate. Charged in full at the time of booking; no refund for cancellation, modification, early departure, or no-show.
  • Holiday, peak-period, or 3+ night stays. May require a 7-day or longer cancellation window; the applicable window is disclosed at booking.
  • Group blocks of 5+ rooms or weddings. Subject to a separate Group Block Contract and deposit schedule.

Modifications (date changes, room-type changes, guest-count changes) are subject to availability and may be priced at the then-prevailing rate, which may be higher than your original rate. No-show. If you do not arrive by 11:00 AM the day after your scheduled check-in and have not contacted us, your reservation will be canceled and the room released, with the first night's room and tax retained as a no-show charge. Early departure does not entitle you to a refund of the unused nights unless agreed to in writing.

6. Check-in, check-out & identification

Standard check-in: 4:00 PM local time. Standard check-out: 11:00 AM local time. Early check-in and late check-out are subject to availability and may incur a fee disclosed at request. All guests must present a valid government-issued photo ID and the credit/debit card used to book at check-in. We may photocopy or photograph the ID for fraud-prevention purposes; the copy is destroyed within 30 days of check-out unless required for an open dispute, investigation, or legal hold (see Privacy Policy § 12).

7. Pet policy

Dogs and cats of all sizes are welcome. The Property charges a flat $25 pet fee per stay (not per night) per pet, with a maximum of two pets per room. Pets must be current on vaccinations, leashed (max 6 feet) in all common areas, never left unattended in a room or vehicle, quiet enough not to disturb neighboring guests, and may not be permitted on the bed unless the guest brings their own bedding cover. Damage caused by pets, including chewed furniture, soiled linens, urine-stained carpet, or scratches, is charged to the guest under § 9.

Service animals. Service animals as defined by Title III of the Americans with Disabilities Act ("ADA") are welcome in all areas open to guests and are not subject to the pet fee or any pet-policy restrictions. In accordance with ADA guidance we may ask: (1) is the animal a service animal required because of a disability? and (2) what work or task has the animal been trained to perform? Emotional-support animals are not service animals under ADA Title III and are treated as pets for purposes of the pet fee.

8. Smoking & cannabis policy

The Property is a non-smoking facility. Smoking, vaping (e-cigarettes), and cannabis use of any kind are prohibited inside guest rooms, hallways, the lobby, the bar, and within 25 feet of any building entrance, per California Labor Code § 6404.5 and applicable San Bernardino County ordinances. Designated outdoor smoking areas are marked. A $250 deep-clean fee is automatically charged to the guest's card on file if smoking or cannabis use is detected in a room. Cannabis use is also subject to California Health & Safety Code § 11362.3, which prohibits use in public places and in non-smoking areas.

9. Damage, incidental holds & lost items

At check-in we may place an incidental authorization hold of $50 to $200 per night (variable by room type) on your card. The hold is not a charge; it is released within 3–10 business days after check-out, depending on your bank.

The guest is responsible for the full cost of repair or replacement of any damage caused to the room, contents, or Property during the stay, beyond ordinary wear and tear. Examples include: broken or stolen furniture; broken glassware (beyond accidental in normal use); stained carpet, mattress, or linens; missing towels, robes, or art; broken electronics; damage to walls; smoking or cannabis penalty (see § 8); and pet damage (see § 7). Damages are charged to the card on file with a written itemization sent by email. Disputes about a damage charge must be raised in writing within 30 days of the charge.

Lost & found. We hold lost items for 30 days. We will return items at the guest's expense via insured shipping; unclaimed items after 30 days are donated to a local charity. We are not responsible for items lost, stolen, or left behind.

10. Property rules & occupancy limits

  • Quiet hours: 10:00 PM to 8:00 AM. The Property is a small lodge; sound travels.
  • Maximum occupancy: Posted maximum room occupancy is firm. Extra guests beyond the reservation may be charged a per-person fee or denied entry. Occupancy includes infants and children.
  • Visitors: Day visitors of registered guests are welcome until 10:00 PM. After 10:00 PM, only registered overnight guests may be on the Property.
  • Parking: Guest parking is on-site. Vehicles must be parked in designated spaces. Trailers, oversized RVs, and commercial vehicles require advance written permission. Unauthorized vehicles may be towed at the owner's expense.
  • Children: Welcome. Children under 12 must be supervised by an adult at all times, including in the pool, spa, fire-pit areas, and bar.
  • Common areas: Outdoor furniture, games, and other amenities are for guest enjoyment; please return where you found them.
  • Camping & tents: Not permitted on the Property.

11. Pool, spa, fire pits & recreational amenities

The pool, hot tub / spa, fire pits, pickleball / basketball court, and other recreational amenities (the "Amenities") are provided for guest enjoyment at the guest's own risk. There is no lifeguard on duty. Posted hours apply. By using any Amenity, you acknowledge that recreational activities carry inherent risks of injury, including but not limited to slip-and-fall, drowning, burns, and exposure to heat or cold. You assume those risks. The Burgundy disclaims liability for injury arising from the proper use of the Amenities except where caused by our gross negligence or willful misconduct, to the extent permitted by California law.

Pool / spa: No diving. No glass containers. Children under 14 must be accompanied by an adult. Persons with cardiovascular conditions, pregnancy, or other contraindications should consult a physician before using the spa. Fire pits: Use only in posted hours. Adult supervision required. Do not leave fire unattended. Use only Property-provided wood / fuel. Comply with all San Bernardino County and CAL FIRE burn-day notices and posted closures.

12. Wi-Fi acceptable use

Wi-Fi access is provided as a courtesy. By using Wi-Fi you agree to use it only for lawful purposes. Prohibited uses include: downloading or distributing copyright-infringing material; sending spam, malware, or phishing content; attempting to intercept or interfere with other users' traffic; or any use that violates applicable law. We may monitor usage for security and abuse-prevention and we will cooperate with lawful requests. Wi-Fi service is provided "as is" without warranty of speed, availability, or security.

13. SMS / text messaging program (A2P 10DLC)

If you opt in to receive SMS communications from The Burgundy via any form on this Site, the following apply. These clauses are also restated in Privacy Policy § 6.

13.1 Program identity

The Burgundy operates a text-messaging program to send (a) marketing messages about special offers, discounts, package deals, and service updates, and (b) non-marketing messages including booking confirmations, reservation reminders, modification notices, group-inquiry replies, accessibility responses, and operational updates such as power-outage notices. Consent for marketing and non-marketing messages is collected on separate, distinct, unchecked-by-default checkboxes; you may opt into one, both, or neither.

13.2 Opt-out & re-join

You can cancel the SMS service at any time. Simply text STOP to the number we send from. We will send you an SMS message to confirm that you have been unsubscribed. After this confirmation, you will no longer receive SMS messages from us. If you want to join again, sign up as you did initially and we will resume sending SMS messages to you.

13.3 Help

13.4 Carrier liability

Carriers are not liable for delayed or undelivered messages.

13.5 Message frequency & rates

As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.

13.6 No sharing

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors who help us provide support services (for example, customer service) is permitted. All other use-case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

13.7 Industry compliance

This SMS program is operated in accordance with the CTIA Short Code Monitoring Handbook, the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and applicable A2P 10DLC carrier requirements. Consent to receive text messages is never required to use our services, complete a booking, or submit a form.

14. Photography & release

The Burgundy and its authorized representatives may photograph or video-record common, public, and event areas of the Property for marketing, social-media, and editorial use. By being present on the Property, you consent to your likeness appearing in such recordings unless you affirmatively notify our staff in writing at check-in that you do not consent. If you submit photos or videos to us (for example, via email or by tagging us on social media), you grant us a non-exclusive, royalty-free, worldwide, perpetual, irrevocable license to use, reproduce, and display the content in our marketing materials, with attribution where reasonably feasible.

15. Group, event & wedding terms

Reservations of 5+ rooms, weddings, full-property buyouts, and corporate or wellness retreats are subject to a separate Group Block Contract or Event Agreement that sets out room block, deposit schedule, food & beverage minimums (where applicable), attrition, cancellation, force majeure, and insurance requirements specific to the booking. 16. Promotional offers, gift cards & package terms

Promotional rates, package rates, and discount codes are subject to additional terms posted on the offer page, including blackout dates, minimum-stay requirements, and combinability restrictions. Promotional rates may be non-refundable and cannot be combined with other offers unless explicitly stated. Gift cards are non-refundable, do not expire, do not earn interest, and are treated as cash for purposes of redemption (loss / theft is the holder's risk).

17. Right to refuse service & eviction

We reserve the right to refuse service or evict any guest, with or without refund, who: (a) violates these Terms; (b) refuses to abide by reasonable requests of staff; (c) is intoxicated or under the influence such that the guest endangers themselves, other guests, or staff; (d) disturbs the quiet enjoyment of other guests; (e) brings unauthorized visitors, animals, weapons, or controlled substances onto the Property; (f) damages the Property or its contents; (g) provides false information at booking or check-in; or (h) violates federal, state, or local law. Eviction is at our sole, reasonable discretion. In keeping with California Civil Code § 51 (the Unruh Civil Rights Act), eviction will not be based on race, color, religion, sex, gender, gender identity or expression, sexual orientation, marital status, national origin, ancestry, disability, medical condition, genetic information, citizenship, primary language, immigration status, age, source of income, or veteran/military status.

18. Force majeure

Neither party is liable for any failure or delay in performance to the extent caused by events beyond its reasonable control, including: acts of God; fire, flood, earthquake, mudslide, wildfire, snowstorm, windstorm, or other severe weather; epidemic, pandemic, or public-health order; war, terrorism, civil unrest, riot, or insurrection; labor strike or shortage; utility, internet, telecommunications, or transportation failure; act of any government, court, or regulator; or any similar event. If a force-majeure event prevents performance for more than 7 consecutive days, either party may cancel the affected reservation; The Burgundy will refund amounts paid for nights not yet stayed.

19. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE BURGUNDY, ITS PARENT, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUE, ARISING OUT OF OR RELATED TO YOUR STAY, YOUR USE OF THE PROPERTY OR THE SITE, OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF YOUR STAY OR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE RELEVANT RESERVATION. CALIFORNIA INNKEEPER STATUTES (INCLUDING CAL. CIV. CODE §§ 1859–1865) APPLY TO LIMIT INNKEEPER LIABILITY FOR LOST OR STOLEN PROPERTY OF GUESTS. NOTHING IN THESE TERMS LIMITS LIABILITY FOR DEATH, PERSONAL INJURY CAUSED BY OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OR FRAUD, WHERE LIMITATION IS PROHIBITED BY LAW.

20. Indemnification

You agree to indemnify, defend, and hold harmless The Burgundy, Travill Holdings LLC, Cedarwood Asset Management, and their officers, directors, employees, agents, contractors, and service providers from and against any claim, demand, action, loss, damage, liability, cost, or expense (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) your stay at the Property or use of any Amenity; (c) your violation of any applicable law; (d) damage to persons or property caused by you, your guests, or your pet; or (e) infringement of any third party's rights by content you submit to us.

21. Disclaimer of warranties

THE SITE, THE PROPERTY, AND THE AMENITIES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, THE BURGUNDY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

22. Intellectual property & DMCA

All content on the Site is owned by The Burgundy or its licensors and protected by U.S. and international copyright, trademark, and other intellectual-property laws. You may not copy, modify, distribute, publicly display, publicly perform, frame, scrape, harvest, or create derivative works from any Site content without our prior written consent.

If you believe content on the Site infringes your copyright, please notify our designated agent under the Digital Millennium Copyright Act ("DMCA") in writing with the information required by 17 U.S.C. § 512(c)(3): [email protected] · 41121 Big Bear Blvd, Big Bear Lake, CA 92315. We respond to valid notices and may remove or disable access to allegedly infringing material in accordance with the DMCA.

23. Third-party links & integrations

The Site may link to or embed third-party websites, services, or content (including the Cloudbeds booking widget, Google Maps, payment processors, OTAs, and social-media platforms). We do not control and are not responsible for the content, accuracy, security, or privacy practices of any third party. Your use of third-party services is governed by their own terms and policies. Links are provided as a convenience and do not imply endorsement.

24. Governing law, venue & dispute resolution

Governing law. These Terms and any dispute arising from them are governed by the laws of the State of California, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Informal resolution. Before initiating any formal dispute, you agree to first contact us in writing at [email protected] and give us 30 days to attempt resolution.

Venue. Subject to the informal-resolution requirement above, you agree that the state or federal courts located in San Bernardino County, California, have exclusive jurisdiction and venue over any dispute arising from or related to these Terms, your stay, or your use of the Site. You waive any objection to personal jurisdiction or venue in those courts.

Jury and class waivers. To the extent permitted by law, you and we each waive any right to a jury trial and any right to participate in a class action, collective action, or representative action against the other.

Statute of limitations. Any claim you wish to bring against The Burgundy must be filed within one (1) year of the date the claim arose, except where a longer minimum period is required by applicable law.

25. Severability, waiver, assignment, entire agreement & notices

  • Severability. If any provision of these Terms is held invalid or unenforceable, the remainder will remain in full force.
  • No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment. You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign these Terms freely.
  • Entire agreement. These Terms, together with our Privacy Policy, our Accessibility Statement, your booking confirmation, and any Group Block Contract or Event Agreement, constitute the entire agreement between you and us regarding your stay and use of the Site.
  • Notices. We will provide notices to you by email (to the address on your reservation) or SMS (where you have opted in); you may provide notices to us at [email protected] or by U.S. Mail to the address in § 27.
  • Headings & interpretation. Section headings are for convenience only and do not affect interpretation. "Including" means "including without limitation."

26. Changes to these Terms

We may update these Terms from time to time. The current version is always posted on this page with the "Effective date" and "Version" updated. Material changes will be highlighted on the Site for at least 30 days before they take effect. Continued use of the Site or the Property after a change constitutes acceptance of the updated Terms.
